City told 2024 is final year to perfect Water Appropriation No. 36821; new application required

City Clerk Jodi Wade told the council that a Nov. 22, 2019 letter from the Kansas Department of Agriculture extended the city’s perfection period for Water File No. 36821 through Dec. 31, 2024. Wade said the state advised 2024 would be the 40th and final full year after approval dated Feb. 28, 1984, and cited K.S.A. 5-8-6(c) which limits municipal water-right development to 40 years after approval.
Wade advised the council the current water appropriations held by the city amount to 94,000,000 gallons and that the state will review recent usage and projected growth to determine a new appropriation amount for the next 20 years. She said she is working with the Kansas Rural Water Association (KRWA) to obtain the necessary application and information.
The council did not take immediate action but directed clerk follow-up to secure application materials and prepare a new filing before the regulatory deadline.
