The Alameda City Council reported out from a closed session settlement proposal with Alameda Marina LLC, under which the city would waive roughly $2,318,399 in park and transportation impact fees and require the developer (referred to in the staff report as "Foundry") to pay the remaining fees, $770,005.20, by Oct. 31, 2026.
City Clerk Laura Weisinger read the settlement terms during the public report from closed session, saying the agreement would also require the developer to comply with the city’s inclusionary housing ordinance and to provide 21 very‑low‑income housing units. Weisinger said the fee waiver would become null and void if the developer did not pull building permits by Oct. 31, 2026, and that the developer would waive all current and future claims against the city related to the matter. The council reported the item carried unanimously when presented in closed session.
The settlement was announced alongside other closed‑session reports on two real‑property negotiation items (the Alameda Theatre and Building 43 at Alameda Point) and an earlier authorized settlement in Miller v. City of Alameda; Weisinger reminded the public that the council had previously authorized the city attorney to resolve Miller for $235,000.
The council’s public report did not include a full settlement document in the record; the city attorney’s office will be the contact for the executed agreement and additional public records once the settlement instrument is finalized and returned to the city for execution.
