City clerk Michael Chadderson told the council the public hearing on Debbie Fortner's Class C liquor license application for the Dugout Bar was held one day outside the 45-day window required by state law, and recommended that the council make no recommendation to the Liquor Control Commission. "What we should do tonight is make no recommendation on the application," Chadderson said, adding he had not received any protests and that the state commission makes the final decision.
Councilman Horner moved to withhold the council's recommendation because the hearing was one day late; after discussion about potential legal challenges to a late recommendation, the motion carried 6 yays, 1 nay. Council did not take a formal position for or against the license; the Liquor Control Commission will make the final licensing decision.
