The Hamilton County Board of Zoning Appeals tabled a variance petition for 220 Duck Creek Lane so the applicants can address lot configuration concerns.
Staff identified a drafting error in the public notice and clarified the board would not consider a front-yard setback—only the side-yard setback was before the board. Petitioner Fernando Otero said he and his son plan to demolish an old house and build a new home, moving it north to create a 43-foot separation from the south neighbor while leaving a roughly 6-foot separation to the north; he added that the north parcel is wooded and is also owned by the family.
Board members and staff recommended the petitioners combine the two lots to avoid a recurring variance issue. The plan director explained combining lots is typically done through the auditor's office and can be straightforward; staff said a signed, notarized agreement to combine the lots within a short time could be accepted if the petitioner needed to start work quickly. The board opened and closed the public hearing and then voted to table the petition so the petitioner can return after combining the lots or providing the required documentation.
