Ross said he has previously provided similar information to the village and read from permit guidance: "It must show existing and proposed topography at 2 foot contour intervals," and argued the submitted survey shows no contours or spot elevations. He told the board a November 2024 attorney letter required an approved grading plan and that a December 2024 municipal-court case resulted in a $158,000 fine for the property owner for not having erosion control and a grading plan; Ross also displayed photographs he said show neighbor flooding and a mudslide breaching silt fencing.
Paul Maggio (Lot 704) thanked the board for earlier approvals and raised concerns about a primary environmental corridor on the Lakeview/Dells site. He urged the board to verify allowable uses with regulators, saying, "I ask you to please verify what can be done on this environmentally sensitive area. Please check with the regulators, Sewer Pack, or the DNR directly to get the truth." Maggio asked staff to confirm restrictions now rather than after development occurs.
