Senator Warren told the committee she and the chair had been briefed on FBI background investigations for the nominees and that the briefing left "significant questions that have not yet been answered." She said colleagues "have a right to be fully up to speed" and moved that the committee go into closed session so staff could follow up on the outstanding issues.
The motion to enter closed session was seconded and the chair asked the room to be cleared. Members debated whether proxies had been submitted and whether a majority needed to be physically present for a prevailing vote. After the closed-session discussion the committee returned to open session and conducted roll-call votes on the nominations.
Warren’s request did not stop the committee from reporting both nominations favorably to the full Senate by recorded vote.
