Staff presented a developer agreement for Oak Valley 2nd Edition, a small rural-style subdivision of roughly six large lots on the south end of Maple Lakes. The agreement implements the city's privately funded public infrastructure policy: the developer will pay a 2% administrative fee based on construction bid price, reimburse third-party inspection costs and cover any city engineering or legal expenses tied to the work.
"This developer agreement is the 2nd developer agreement the council is seeing that has implementing the city's new privately funded public infrastructure policy," a staff member said, and the agreement includes covenants requiring property owners to maintain drainage features, as-built drawings, and a requirement that the city engineer review plans and specs before construction.
Council discussed the rural aesthetic for that area, stormwater management (concrete flume at the bottom of the ditch was discussed to maintain grade) and recording covenants that hold property owners responsible for ongoing drainage maintenance. The council made a motion and approved the agreement.
Next steps: city staff will record covenants and ensure inspection/plan-review requirements are met as the project advances.
