Planning commission approves Ferguson Kia preliminary plat after resident raises light-pollution concerns

The Broken Arrow Planning Commission voted to approve the preliminary plat for Ferguson Kia (Plat 2024-2025), a single commercial lot of approximately 6.37 acres near the southeast corner of Elm Place and the Broken Arrow Expressway. Staff told commissioners the lot meets CH zoning standards as modified by the PUD, includes an overland drainage easement along a blue-line stream and is not located in the 100‑year floodplain per FEMA maps. Staff recommended approval subject to attached comments from the technical advisory committee.
A written comment from resident John Lindman, read into the record by staff, asked the commission to protect nearby neighborhoods from ‘‘further excessive light pollution’’ following a prior dealership expansion. Henry (staff) read Lindman’s letter, which requested that the commission require a developer lighting plan and compliance with dark‑sky-style illumination limits: "I had to purchase light blocking curtains for our bedrooms just so we could sleep at night," the comment said. Staff told the commission that lighting is checked at site‑plan review and that the city measures illumination at the property line under the zoning ordinance; staff also advised that the resident could file a code‑enforcement complaint about existing lighting.
Commissioners approved the preliminary plat by roll call with one abstention (Jason Cohen). The motion carried; staff and the developer will proceed to the site‑plan stage where lighting diagrams and illumination standards will be reviewed and any required conditions will be applied. The commission noted that utilities are available from the city of Broken Arrow and that the TAC reviewed the plat on March 4, 2025.
