The Junction City Council adopted Ordinance No. 1 on April 14, approving a negotiated, nonexclusive franchise agreement with Douglas Fastnet that allows the company to construct, operate and maintain telecommunications facilities in the city’s public rights of way. Administrator Nivol told the council the agreement defines restoration requirements and other operating conditions and "provides that they will provide a monthly franchise fee of 5% of gross revenues to the city," language read during the staff presentation.
Councilors voted to read the ordinance by title and then to adopt it on a unanimous vote. The ordinance establishes that it will take effect 30 days after approval, authorizes the mayor to execute the agreement, and tasks the city recorder with forwarding the ordinance to the franchisee for acceptance. The action was presented as a standard right-of-way franchise; the administrator recommended approval after legal review. The council’s vote carried with no recorded no votes or abstentions.
