La Cygne council adopts revised cemetery rules, softening item restrictions

City Clerk Jodi Wade presented Ordinance No. 1538, replacing Chapter 11: Public Property; Article 1: Cemetery of the City code. The council reviewed the paragraph that would prohibit items that "shall interfere with the mowing, trimming and other duties of care and maintenance within the cemetery," and voted to replace the word "shall" with "may." Council Member Thomas Capp moved to approve Ordinance No. 1538 with the modification; the motion was seconded and recorded as passed 3-0.
The ordinance language discussed reads in part: "No walkways, boxes, fences, edging material, mulch material, gravel, chairs, settees, structures, or other materials or items of any kind shall be permitted which shall interfere with the mowing, trimming and other duties of care and maintenance within the cemetery." The change to "may" narrows the mandatory prohibition to allow more discretion in enforcement and maintenance decisions.
