Staff propose stricter drainage rules and point to county programs for septic issues

Staff proposed new IRC language making discharge of gutters, sump pumps and drains within 10 feet of an adjacent property line prima facie evidence of a violation when that discharge causes stormwater damage to neighbors. Brian said the change targets recurring runoff problems in new home construction and will improve plan review and inspection practices.
“There are some provisions that are in the code ... that we made,” Brian said, adding that when staff find a discharge to a sanitary line they coordinate with Johnson County Wastewater. He noted a county program that assists homeowners in correcting improper sump‑pump connections or other misdirected drains and said a handful of Mission homes north of 51st Street remain on septic systems where county rules and sale‑time inspections apply.
Council members probed how grandfathered conditions will be handled and whether the code will require retrofits; staff replied these would be addressed case by case and that site‑plan and inspection triggers are designed to capture problematic new work rather than automatically require changes to all existing conditions.
