The ordinance defines a “full-service restaurant” and bars establishments whose gross revenue derives primarily from alcohol from qualifying. It requires license applicants and renewal applicants to provide confidential documentation showing that food and nonalcoholic beverages account for a primary share of revenue; the ordinance requires an annual report verifying that at least 60% of gross revenue in the preceding 12 months was from food and nonalcoholic beverages. The ordinance conditions license renewal on the city receiving documentation that not more than 40% of gross sales derive from alcohol. The ordinance also sets the initial license fee at one dollar per resident as measured by the last decennial federal census and allows the council, by resolution, to set a renewal fee that by state law may not exceed $1,500.
