Council approves sewer easement offer for Dunaway parcel on Cherry Lane Phase 3B

A staff presenter explained the valuation approach: legal staff used an $85,000-per-acre basis that had been paid in a separate right-of-way action (higher than an appraisal of $71,500 per acre) and then calculated the easement payment at half the land value per square foot; a temporary easement figure was calculated at 10% per square foot. The presenter said the easement offer totals $37,900 for the Dunaway parcel and asked council to approve that offer and to give the legal department authority to proceed with eminent domain if necessary.
Council moved, seconded and approved the requested easement offer and authorization. The presenter said legal had already worked with the individual property owner; staff said approval would allow staff to continue negotiations and, if no agreement is reached in the prescribed time, to pursue condemnation.
