City planner says LUBA found PUD expired; staff readies development code modernization

At the March 19 meeting, City Planner Tapia briefed commissioners on a recent Land Use Board of Appeals (LUBA) final decision related to a remanded PUD. Tapia said LUBA "issued its final opinion regarding the City Council's decision...and sided with the City on the grounds that the PUD had expired," and that the deadline to appeal has passed with no notice of appeal from the other party. Tapia added the city sought an award of attorney fees from LUBA related to costs it accrued during the litigation.
Tapia also told commissioners that staff and the consultant Cascadia Partners are ready to begin the development code modernization project; the only outstanding item is dispersal of grant funding from the Department of Land Conservation and Development (DLCD), which Tapia said they expect to receive this month. The project will update zoning and subdivision ordinances, the comprehensive plan and map, and the planning commission will serve as the advisory committee through the process.
