Staff presented a rezoning request for 122 acres near I-575 to R-20 for a conservation subdivision (144 lots) that would preserve approximately 67% of the site in open space. The parcel lies partly within Ball Ground city limits and the application includes several concurrent variances to city codes. The proposal includes an internal trail connection under the interstate and potential deed or dedication of conserved parcels to the city.
Applicant counsel framed the layout as a conservation subdivision that uses ridgelines and the site's topography to minimize grading and avoid large retaining walls. Counsel said the conservation land could be deeded to the city and stressed the project's potential for trail access under I-575 to extend Ball Ground's trail system.
Staff recommended 27 conditions (largely drafted by the city) and suggested adjusting condition 23 so the developer "shall meet with the Cherokee County School District to discuss mitigation fees per lot" rather than a fixed per-dwelling fee being set in the condition. Commissioners expressed support for the conservation layout and for preserving access under the interstate; after discussion they moved to recommend approval with the city's conditions and the staff revision to item 23. The motion passed by voice vote.
