The Tulsa Metropolitan Area Planning Commission on July 2 denied an application from Hemphill Legacy, LLC to rezone a narrow 2.5‑acre parcel west of the southwest corner of East Newton Street and North New Haven Avenue from RS-3 to IL and rejected a companion Comprehensive Plan amendment (CPA-119) to change the land‑use designation from Neighborhood to Employment. Staff recommended denial, citing that the property contains FEMA floodway and floodplain areas, has received code enforcement citations, and that the Development Review Guide identifies the site as “least suitable” for Employment uses.
Applicant representative Ralph Weingarten (Faulk & Foster) said the parcel sits among a patchwork of industrial and residential uses and asked the commission to shift the boundary; staff said the parcel has been non‑compliant for at least 10–15 years and raised concerns about stormwater and required setbacks for IL adjacent to R zoning (IL requires a 75‑foot building setback from adjacent R‑zoned properties and the parcel width is roughly 160 feet). Commissioners voted to deny the rezoning and the plan amendment, motion by Bulmash, second by Shivel; vote 6-1-0 (Walker opposed). The denials will be forwarded as recommendations to City Council.
