Representative Heather Scott introduced RS33227C1, a revisitation of recently printed language (House Bill 524) that aims to clarify Idaho's child custody interference statutes for law enforcement and the public.
Scott said the draft adds clearer affirmative defenses, guidance for law enforcement on the point of contact and a graduated penalty structure modeled in part on trespass laws, and she requested a small editorial change (change "all" to "any" on page 2, line 3). Representative Marco Erickson moved to introduce RS33227C1 with the edit; the motion carried.
Representative Behar added that the changes were intended to improve the statute after feedback from prosecutors, courts and citizens, and not simply to appease critics. The RS will be introduced and follow the committee process for bill drafting and printing.
