Committee approves H521 technical fix after FBI review of fingerprinting statute

Representative Mike Pohanka told the committee the FBI's Criminal Justice Information Services office had notified Idaho that the language inserted into Idaho Code 60‑738 (the umbrella statute) was not the appropriate location. Leila McNeil, Bureau Chief of the Criminal Identification Bureau at the Idaho State Police, explained the FBI had discontinued pre‑enactment review and that Idaho is on a grace period to remove the newly inserted language. "The changes brought before you are to remove the newly inserted language from Idaho code ... The new language and subsection does not add or change any current practices for these entities to vet individuals serving vulnerable populations," McNeil said.
Representative Schurz moved to send H521 to the floor with a due‑pass recommendation and the motion carried.
Next steps: the bill will go to the House floor for consideration with the committee’s due‑pass recommendation.
