Panel advances bill to set priority for juvenile court fee payments

The committee voted to send RS33147 to print. The measure would place into statute an ordering for allocating partial payments among about 15 juvenile-case fee categories so courts and case-management systems apply payments consistently.
Jason Spellman, legal counsel for the Administrative Office of the Courts, told the committee RS33147 would establish a statutory priority for distributing partial payments across multiple juvenile-case fees. "We are proposing... to establish a priority of how, the payments that are received are distributed, so that we can configure our system to do exactly what the legislature would like," Spellman said.
Spellman said courts currently resolve the order of satisfaction by court order, but the bill would codify that ordering and accommodate future fees by placing the priority in statute. He said the draft lists roughly 15 fee categories and the office is open to legislative direction about where new fees should be placed in the priority. Senator Lent moved that RS33147 be printed, the motion was seconded and carried by voice vote; the RS will be printed for a fuller hearing.
