Senator Nichols’ RS clarifies residency restriction for registered offenders near locally permitted daycares

Senator Tammy Nichols (District 10) presented RS 33,024 to the Senate Judiciary & Rules Committee as a narrow technical fix to Idaho law intended to close a gap between licensed daycares and some locally permitted daycares.
Nichols explained that current law restricts registered *** offenders from establishing residence near licensed daycares but that some legally operating daycares are permitted at the local level and were not covered by the language. "So this bill clarifies that the residency restrictions apply also to daycares that are zone permitted, by local government," she said. She emphasized the change only applies to residencies established after the effective date and that it does not impose new licensing obligations or enforcement authority.
Senator Foreman moved and Senator Lenny seconded a motion to send RS 33,024 to print; the motion carried on a voice vote and the RS will be printed for further consideration.
