Lieb replied that the commission's jurisdiction covers only licensed real estate professionals and that it enforces laws and commission regulations against licensees. He told the committee: "We dismiss about 90% of complaints that we receive," but the commission investigates complaints and pursues those cases it believes it can prevail on in disciplinary hearings.
The chair called for a motion to "advise and consent." A motion was made and carried by voice vote; the committee reported Lieb's nomination to the full Senate.
Lieb answered committee questions and said he regularly advises members of the public to consult private counsel when a matter falls outside the commission's jurisdiction. He acknowledged the limits of MREC's authority and urged the committee to expect enforcement actions only where the commission has jurisdiction over licensed professionals.
