The Yadkin County Board of Adjustment on June 8 approved a variance to allow an existing 10-by-20 accessory building at 1824 Gospel Way Church Rd (parcel #132408) to remain outside the ordinance’s rear-yard placement requirement. Chair Richard Foster opened the public hearing and planning staff outlined that the parcel is roughly 0.8 acres and zoned Rural Agricultural.
Applicant Eric Miller told the board he "purchased a prebuilt accessory building and was told by the seller that he did not need a building permit for the structure." Miller said the structure is a repossessed Amish-built unit placed about two years ago to clear stored items from under a carport and to allow ambulance access; he said there is no power to the building. Miller said the topography behind the house — a gulley that also contains the septic system — prevents moving the building to the required rear yard location.
Planning and zoning officer Kaelan Everhart reviewed the four statutory criteria for a variance (unnecessary hardship; hardship peculiar to the property; not self-created; and consistency with the ordinance’s spirit and public safety). Staff said notice requirements were met (sign, legal ad, mailed letters) and that the case drew one inquiry from a neighbor. No members of the public spoke against the request.
Vice Chair Jeff Smith moved to approve the variance; Chuck Wooten seconded and the motion passed unanimously. After the vote, staff member Brittany Anderson told Miller he may now apply for zoning and building permits to regularize the structure. The board’s record cites the county zoning variance provisions (111-124(b)1–4) and the public-notice requirement (referenced as Attachment 2 / 111-123(m)).
The Board of Adjustment is a quasi‑judicial body; appeals from its decisions are made to Superior Court, the board noted. The variance approval allows Miller to proceed with the permit application process but does not itself serve as a building permit.
