The Butler County Planning Commission recommended approval of RZ 26-01 (rezoning from AG-40 to RE) for property at 3551 SW Prairie Creek Road and approved an associated lot split (PL 26-01) and variance (VA 26-01) to allow a 2-acre lot around the existing home.
Staff explained the property lies inside the county’s Urban Growth Area and within the City of Benton’s extraterritorial jurisdiction; the City had no objections. Neighbor Bill King told the commission he was "not opposed to the lot split, but is opposed to the rezone." Realtor Jeremy Sundgren said he has a buyer under contract and that the contract is contingent on the rezone.
Commissioners discussed township responsibilities, access and emergency vehicle turnarounds, and the long-term planning implications for Benton’s growth area. Planning Commissioner Ralston moved to recommend approval of RZ 26-01; the motion carried 6-0 (Ralston motion, Flaming second). The commission then approved PL 26-01 (lot split) and granted VA 26-01 (variance to allow the 2-acre lot) by unanimous votes.
The record includes staff guidance that converting to RE will remove a property’s legal nonconforming AG-40 status and that future platting or sale could trigger additional requirements and coordination with the City of Benton.
