The Butler County Commission approved a general release and disclaimer Jan. 6 to relinquish the county’s remaining interest in a 0.6-mile rail right-of-way east of Augusta. County Administrator Will Johnson recounted that the county acquired the corridor in 2001, salvaged rail property in 2004, and later faced Department of Justice litigation that led to restoration of rights to adjoining landowners and Notices of Interim Trail Use (NITU) with the cities of Andover and Augusta. Johnson said adoption of the release would transfer the remaining ROW segment and the county would no longer have control or responsibility for that portion.
Commissioner Marc Murphy moved to approve the general release; Commissioner Kelly Herzet seconded and the motion carried 5-0. Staff did not state further financial terms in the transcript.
