Kyle Rogos of Polk County Land Development presented a request for a 6,000-square-foot accessory pole barn at 5619 Highway 60 East on July 14 and recommended approval with conditions limiting the structure to residential storage. "It is part of the conditions of approval... no home based business or commercial uses shall be permitted to occur within the accessory structure," Rogos said.
Applicant Eric Langston told the hearing officer the structure will be enclosed and that he and the property owners understood and accepted staff's recommended use limitations. The hearing officer opened public comment and none were offered for this case. Claytor noted his order will be based on today’s evidence and that a written final order will follow within 14 calendar days.
Staff emphasized the condition is intended to prevent conversion of the structure into commercial storage or an accessory dwelling, and said that compliance will be monitored through the building-permit process and any necessary code-enforcement follow-up.
