Polk County adopts resolution to vacate portion of Roosevelt Street in Bevington Manor

Scott Lowry, Lehi estate services support manager, presented a petition from Jim Schultz to vacate a portion of platted, unopened and unmaintained right-of-way shown as Roosevelt Street on the Bevington Manor plat. Lowry said the petitioner recently purchased Lots 119 and 120 and discovered an existing residence partially located within the right-of-way, creating an encroachment.
Lowry told the board that owners east and south of the petitioner’s property had objected to the vacation but that access remained available to those properties from remaining rights-of-way and that appropriate utilities and county divisions were notified without objection. Staff recommended adopting a resolution to vacate the right-of-way; no public speakers signed up and the board adopted the resolution by voice vote.
Lowry indicated he would remain available for questions during the meeting and the board proceeded to a unanimous vote to adopt the resolution.
