Planning staff explained the overlay (effective July 10) prohibits new vehicle repair and certain outdoor storage uses in the district; staff also found the site plan omitted required survey and easement details, parking justification and maneuvering dimensions. "The proposed use does not align with the Van Dyke Mixed Use District," staff said, recommending denial.
Neighbors, a local church and existing operators including Master Tech Auto argued the area already has multiple auto-related businesses and said another shop would harm established livelihoods and the neighborhood. "If you put another mechanic's shop there, he's going to suffer," one nearby business owner said.
Commissioners moved to deny based strictly on the ordinance and planning staff recommendation; the motion carried in roll call.
Next steps: Applicant may revise the proposal or pursue variances, but the overlay rules present a legal bar to approval at this location without zoning relief.
