The court discussed a variance appeal for construction of a 50-by-40 metal storage building at 1305 Byron Road but did not act on the request April 28 because the administrative process has not reached a denial that would trigger an appeal hearing.
The judge said the fire marshal would present first to outline required permit steps. The fire marshal explained how to complete the building permit, outlined site and architectural guidelines, and described the board of appeals process that would hear a requested variance once a formal denial is issued. "Once that's done, then there would actually be a board of appeals meeting and at which time you'd have an opportunity to come up to visit with them as well," the fire marshal said, and offered follow-up meetings with staff to assist with the application.
The property owner described the planned building as a metal shop to house a skid steer, an air compressor and daily-use tools for his dumpster business; he said he prefers to keep storage in Kaufman County. John Beasley, who gave his address to the court, said an earlier meeting with development services and the fire marshal left the applicant unclear about next steps and that the court conversation provided more actionable guidance. Because no denial has been issued, the court concluded there was "no decision" to be made today; the matter may return if a formal denial or appeal is filed.
