Geneva County adopts Open Records procedures and names County Administrator as Public Officer

County Attorney Phil Eldridge presented the amended Open Records Act (Ala. Act No. 2024-278), which takes effect Oct. 1, 2024, and the commission adopted two resolutions implementing the new law's procedural requirements.
Eldridge said the amended act contains mainly procedural changes; the commission approved a resolution appointing County Administrator Cindy Williams as the county's Public Officer to oversee public-records requests. "The ACCA provided resolutions which Mr. Eldridge tweaked for Geneva County," the meeting minutes state. Commissioner Weston Spivey moved to adopt the resolution appointing Williams; Commissioner Wade Fulford seconded and the motion passed 4-0. On a separate motion (4-0) the commission adopted amended procedures for responding to records requests, which require acknowledging receipt within ten days and providing a substantive response within fifteen business days after acknowledgement.
The commission's resolutions are recorded in the minutes and accompanying resolution text adopted at the meeting. The board's action implements the county procedures that staff said were already largely in place but now conform to the statutory timeline in Ala. Act No. 2024-278.
