The La Porte Planning and Zoning Commission voted to deny a proposed commercial plat for the 55.02-acre Carson LaPorte development after staff told the commission the submittal did not meet several municipal requirements.
City planning staff told the commission the plat, generally located south of State Highway 225 and east of Sendh Road, had been submitted Aug. 11, resubmitted Aug. 29 and reviewed again Sept. 11. Staff said the filing lacked required adjacent-property labels, failed to show an access easement that would prevent landlocking neighboring properties and did not meet cul-de-sac and pavement-radius standards in the city’s Public Improvement Criteria Manual. “Texas local government code says that we must act within 30 days of the plat being filed, and it gives you three options to consider,” a staff presenter said, advising the commission that a failure to act would result in automatic approval under state law.
After discussion about whether a conditional approval would allow the developer to correct the issues without restarting the plat process, Commissioner Steve Gillette moved to deny the replat; the chair counted five votes in favor and the motion to deny carried. City staff said they would prepare the required written statement outlining the specific code sections the submittal failed to meet.
Shortly after the vote the chair announced the item had been withdrawn; staff explained withdrawn items typically are removed from the public packet and will return when the applicant has provided complete information. The record shows staff told the commission the applicant had agreed to the listed conditions and that resubmission was in progress. The commission’s denial and the subsequent withdrawal both appear in the public record of the meeting; staff said the case will be returned to a future agenda once corrected.
