House advances bill to standardize Brady-list procedures and officer due process

The House took up HB 12-54, a bill that would define procedures for prosecutorial Brady lists and set due-process and confidentiality rules for officers placed on such lists.
Sponsor Representative Alexander described the measure as returning due process to officers and standardizing definitions and procedures across jurisdictions. "It requires notice before placement, including a summary of the justifications and the officer's right to provide input," Alexander said on the floor, explaining the bill also provides a path for reconsideration and removal when warranted and protects records from public-record requests while allowing disclosure to officers, counsel and courts as permitted by law.
Members asked whether records would be shared between jurisdictions, and whether the bill addresses interstate access for officers who move across state lines. Alexander said the bill did not address interstate access; he added that the proposal was drafted with District Attorneys and law enforcement organizations and is intended to standardize existing practices while protecting confidentiality. The chamber recorded the bill's passage by roll call on the third reading as presented.
