Commission grants setback variance to allow parcel reconfiguration at 7567 Persimmon Tree Road
Summary
A 4‑0 Planning Commission vote approved a variance reducing the right‑side yard setback from 15 to 5 feet for an existing accessory structure so a 143.73± acre parcel can be reconfigured; the plat review required the variance because the detached garage would encroach on a proposed tract.

Hall County planners and the Planning Commission approved a variance on March 3 to allow a detached garage to remain within a reduced right‑side yard for a parcel at 7567 Persimmon Tree Road. Katie Greenway summarized staff’s review of a plat (HPLT24‑0162) for reconfiguration and subdivision of the approximately 143.73± acre property; the plat showed the garage encroaching into the proposed Tract 1 setback. ReNee Conley presented the applicant’s request. The motion to approve carried 4‑0, with Commissioner Sosebee absent.
Staff records included that the property contains a single‑family residence built in 1976, a second residence built in 2020 (RES2020‑10249), and 22 accessory structures constructed between 1976 and 2015; the submitted site plan indicated five accessory structures would be removed, although not the structure affected by the proposed boundary change. The commission’s approval allows the plat to move forward to staff review subject to the variance being granted.
