County staff presented draft amendments to the subdivision ordinance intended to align local text with recent state law changes (including references to Senate Bill 974 and Code of Virginia provisions) that shift some plat review functions to a designated agent and shorten review timelines.
Staff (S5) summarized the change: "The designated agent shall act on any proposed plat within the 45 days," and said the new statutory language eliminates the planning commission as the designated agent in most cases. Commissioners asked whether that administrative path would preclude public review. Staff replied the commission could still receive plats for informational public review but could not be designated as the agent. The panel also sought clarity about whether timeframes referenced calendar or working days and whether routing to agencies (schools, VDOT, health) would continue; staff said agencies would still be routed and that appeals remain available (for example, to the BZA) for disputed denials or interpretations.
Given the legal nuances and the commission’s desire to preserve opportunities for public input, a motion was made to table the ordinance amendments until the July planning commission meeting to obtain a written opinion from the county attorney and to confirm the commission’s role in the revised process.
