Sargent shop variance approved for 26-foot structure on 1.03-acre lot
Summary
The commission approved VAR25-0005 allowing Jake and Alicia Sargent to locate a 26-foot-tall, 40-by-80-foot shop 12 feet from the property line where 22 feet is required; commissioners cited site constraints and found the variance met criteria (4–1 vote).

Jake and Alicia Sargent told the commission Jan. 8 that site constraints — well and septic locations — left one feasible location for a 40-by-80-foot shop. The applicants requested a reduction from the 22-foot setback required for a 26-foot-high structure to 12 feet.
Commissioner Sean Priest confirmed the shop's wall height and commissioners discussed the 2023 adoption of variable setback rules designed to address snow-shedding and fire safety. Commissioners found the petition met variance criteria given the lot configuration and distance from other structures; the motion passed with four affirmative votes and one negative vote recorded.
The commission noted applicants could reduce building size or roof pitch to limit height in other cases; Commissioner Warren Albertson and staff said safety concerns did not appear present for this site.
The approval is a site-specific variance; staff will note conditions and the decision in the record.
