Board approves four home-occupation special exceptions; attorney warns covenants may still restrict businesses

The board approved four Special Exception Applications for home-occupation businesses during the Sept. 3 meeting: #2793 (Larry & Anita Foreman, Executive Transport Services), #2794 (Darius Gibson, Medical Transportation), #2795 (Austin Clements & Baylee Irby, Fencing and Patio Business) and #2796 (John & Emily Gugino, Mobile Mechanic Business).
Chief Building Inspector Tim Andrews noted that applicants approved by the board should next apply for a county business license in the Commissioner's Office. County Attorney Tom Hall reminded applicants that "even if the Board of Commissioners approves an application, neighborhood covenants may still impose certain restrictions upon or against home businesses. These restrictive covenants are not superseded by any action the Board of Commissioners takes." The approvals were recorded as unanimous motions with standard stipulations noted on the Zoning & Appeals recommendation and Section 95 Requirements staff report.
Applicants whose special exceptions were approved were instructed by staff about next steps to obtain business licenses; the minutes also record that one applicant (#2795) had previously addressed objections by securing a commercial building for material delivery and employee gatherings.
