Legal concerns send Mill Creek amended plat back to Planning and Zoning; proposal would switch from central water to individual wells

Jefferson County planning staff presented proposals to amend the previously recorded Mill Creek subdivision so the central water system dedication would be replaced by individual private wells.
Planner Milton Ollerton and staff member Jenna Huennekens said the application originated in December 2020 and had been tabled earlier because a moratorium was in effect. Concerns were raised about access onto N 4200 E; county legal counsel recommended sending the matter back to the Planning and Zoning Commission for further review. The board did not take action on the item at the meeting.
Ollerton also reported a recent meeting with the Health Department to explore approaches for determining septic density for subdivisions and noted that county HVAC inspections are now available but are not yet permitted inside city limits until local ordinances are updated.
