Harvey County planning board approves conditional-use permit for Black Kettle Retrievers kennel

Rothe, the zoning director, presented background information to the board, noting that Ross operates the kennel on a parcel adjacent to her residence and that Ross and her family own most surrounding parcels. Rothe said the business operates "under the limit of dogs the state of Kansas requires licensing for," and that Ross composts the dogs' feces. Rothe also reported that the township had required Ross to remove a sign in the right-of-way; that sign removal has been completed. When Rothe asked whether vaccination and veterinary records were required for dogs in her care, Ross said, "yes."
The commission found no unresolved issues and moved to approve the permit with three remaining conditions: obtain state licensing if required by Kansas, continue healthy management of feces on the property, and remain in compliance with county requirements. Commissioner Tessa Wendling moved to approve the CUP; Commissioner Martie TenEyck seconded, and the motion passed unanimously. Seven members were recorded present for the vote (Justin Stucky, Joni Embree-Meinders, Greg Claassen, Daryl Regier, Mike Weber, Tessa Wendling, Martie TenEyck).
The permit approval includes the three stated conditions; the board did not add further operational restrictions at the meeting. The decision finalizes the planning commission’s review, subject to compliance with the conditions and any required state licensing.
The commission did not record a schedule for follow-up inspections at the meeting. Any future compliance concerns or complaints would be handled under existing county procedures.
