KDHE approvals and floodplain rules must be met before Pete's Puddle permit is finalized

Harvey County staff informed the commission that Conditional Use Permit CUP24-06 for Pete’s Puddle will not be finalized until the applicant provides proof of KDHE approval for potable water and wastewater treatment, an inventory of existing structures and the outstanding building permits requested by staff.

Planning & Zoning Director Karen Rothe said staff contacted KDHE to confirm whether the venue’s water and sewage systems meet state requirements; she also noted the property sits in a FEMA Special Flood Hazard Area. County code (Harvey County Unified Development Code Sections 16.05 and 15.25) was cited by staff as relevant: campgrounds and RV parks in A zones must meet KDHE requirements and RVs placed on sites in A zones must either be on site fewer than 180 consecutive days and be highway-ready with current tags, or meet manufactured-home permitting, elevation and anchoring rules. The commission recommended a condition specifying KDHE proof of compliance and documentation of current structures and permits before the permit is finalized.

The record shows that failure to obtain required KDHE approvals or building permits would prevent finalization of the CUP; staff also noted the commission has the authority to review a CUP if conditions are violated after issuance.
