Key changes include defining 'culvert' to mean only stormwater conveyance devices and defining 'culvert structure' to include the pipe, walls, outlets and openings; changing culvert-cleaning language from 'no flow' conditions to 'low' flow conditions; and replacing references to a 'wetland consultant' with a 'qualified party' such as the Conservation Agent or another party approved by the commission.
The proposed revisions would also allow the Conservation Agent, with prior approval from the chair, to perform duties that previously required engaging an outside wetland consultant, and would change several procedural timelines to include the agent (for example, final determinations and erosion-control plan modifications). The commission noted the edits are being coordinated with DEP staff, including Mark Stinson, and that a new hearing on the amended Bundled NOI will be opened at next month’s meeting.
