Selectboard adopts short‑term rental ordinance with appeals board and daily fines

The Londonderry Selectboard voted unanimously April 20 to adopt a revised ordinance regulating short‑term rentals in town. Short‑Term Rental Coordinator Andy Dahlstrom presented the ordinance changes, which the short‑term rental working group had approved earlier the same day and which were reviewed by the Town Attorney.
The ordinance creates an Appeals Board — an ad‑hoc panel of three members plus an alternate to be appointed by the Selectboard after final attorney review — to hear administrative appeals under the ordinance; appeals of assessed fines are judicial in nature. It also requires each approved short‑term rental to display an issued placard in all advertisements and authorizes ticketing beginning on the first day an unlicensed property is advertised, with fines assessed per day of noncompliance. Jim Fleming moved to adopt the ordinance as amended, with the ordinance taking effect 60 days after adoption unless a petition is filed under 24 V.S.A. § 1973(b); the motion passed unanimously.
The board discussed the formation process for the Appeals Board; Dahlstrom said the Selectboard will vote on the structure and members will be chosen through an application process posted on the town website. The adoption follows the working group’s unanimous approval and the Town Attorney’s concurrence, as recorded in the meeting packet. The Selectboard will consider the Appeals Board structure at an upcoming meeting and will publish related application materials online.
