Council receives annexation petition for Bay Ridge Road site, applicants propose 39-unit plan with 15% MPDUs

Mayor Littman opened a preliminary review of a petition to annex a 5.4‑acre parcel along Bay Ridge Road, a long‑vacant site that the applicant said previously had been slated for a Lidl grocery store.
Chris Jakubiak, the city’s planning and zoning director, told the council the city’s comprehensive plan specifically identifies the parcel as appropriate for annexation and that the council’s role at this stage is to receive the petition and refer it for technical review. "If we do it right, annexation is also the process by which we implement our comprehensive plan," Jakubiak said.
Attorney Alan Hyatt, representing petitioner GSX Solutions LLC, said the petition meets state code thresholds and that the concept plan initially showed 49 townhomes but was revised to 39 units after planning commission feedback. "We have shown a new plan with 39 units," Hyatt said, adding that the petitioner has requested R‑3 zoning that would, he said, match county density limits and not substantially increase allowable density under state law. Hyatt noted the project would include a 15% requirement for moderately priced dwelling units.
Councilmembers pressed staff and the applicant on process and impacts. Mayor Littman and Jakubiak confirmed annexation approval is separate from later development approvals and that the council would later consider an annexation resolution and a zoning ordinance. Alderman Savage asked that trails shown through conserved forest be recorded as public access easements and requested referral to the transportation board to coordinate road‑diet and intersection improvements along Bay Ridge Road. Jakubiak recommended referrals to fire, police, transportation, public works, planning and zoning, finance and the planning commission for technical and departmental review.
The council moved to refer the petition to the city manager’s office and the planning commission, and the motion passed. The applicant said it expects to return for a public hearing and formal annexation resolution after departments complete their technical reviews and the planning commission reviews the concept.
