Commission postpones decision on carport variance at 1221 West Park after concerns about side-yard encroachment

The commission elected to postpone action on a requested variance for a carport that staff said encroaches 2 feet 6 inches into the front setback at 1221 West Park. Planning staff noted the carport was built without permits and that the front beam sits about 6 feet 8 inches from the curb, but that the overhang would not block a future sidewalk. "Once we got ahold of the owner, she came in to try to get the variance... From everything I can tell, the carport is over the property line by 2 foot 6 inches," the planner said.
Several commissioners raised concern about the side-yard alignment and the lack of building permits. One commissioner said the side-yard issue "needs to be corrected" and suggested the vote be postponed until commissioners had time to review the paperwork and meet with staff and the applicant; the commission voted to table the item to the next meeting and asked staff to provide documentation and to meet with the planner and applicant before taking further action.
