Don Cain says Isleton special meeting may violate Brown Act

Don Cain, an online caller, told the council during public comment that the special meeting "may be invalid" under the Brown Act and argued the only people who can call a special meeting are "either the chair, or a majority of city council." He said he had learned that Mayor Ivan Walton, Vice Mayor David Kent and Council member Pamela Boulian had not requested the meeting and warned, "If you do not, you will have a cure and correct letter in your hands tomorrow."

Council members pushed back during the exchange, with one council member saying a majority of the board had indicated they would hold the special meeting and did not see problems with proceeding. The dispute centered on whether staff contact asking if a 6:00 a.m. start was acceptable counted as authorizing a special meeting under the statute Cain cited. The council did not adopt any immediate formal remedy in response to Cain's comment; instead, members discussed conflict and recusal issues tied to an upcoming closed session. The council then recessed briefly and moved into closed session to discuss a personnel-related matter and anticipated litigation. The regular meeting was scheduled to resume at about 06:30.
