The City of Bandon Planning Commission voted to approve a setback variance for a single-family lot at 663 Seacrest Drive at its Feb. 26 meeting. The commission approved a reduced front-yard setback (requested reduction from 20 feet to 15 feet) and a reduced side-yard setback (requested reduction from 15 feet to 5 feet) after a staff recommendation in favor of the application.
Commissioner Frey opposed approval, saying the hardship appeared to be created by the owner’s purchase decision. "I believe the applicant purchased the property... and I believe now, that in essence, makes the need for the variance imposed by the applicant," Frey said during deliberations. Staff disputed that interpretation and urged the commission to weigh the site’s physical constraints and the city’s variance criteria.
Staff said the property’s steep slopes and a hammerhead turnaround reduce the buildable area substantially, a key factor in the recommendation. The motion to approve passed on roll call after deliberation; Commissioners Orsi and Freeland voted to approve and Commissioner Frey voted no. A commissioner who had recused herself earlier did not participate in the vote. The commission did not further appeal the entitlement at the meeting; staff noted an appeal process is available.
