Homeowners association asks to lower signature requirement; hearing examiner approves 51% threshold

Churchman Manor Homeowners Association asked the hearing examiner to lower the property-owner signature threshold to terminate a developer commitment; the examiner approved changing the filing requirement from 100% to 51% for that process.
Nicole Jones, representing the Churchman Manor Homeowners Association, told the hearing examiner that the association had previously been told the termination threshold had been lowered from 100% to 50% and asked for a waiver to allow the lower threshold in order to remove a developer commitment. Jones said prior guidance had been inconsistent and requested clarity for the associations ability to modify covenants, conditions and restrictions.
After brief discussion about whether the threshold should be 50% or 51%, the hearing examiner approved the special request to change the required number of property-owner signatures to 51% for filing a termination or modification of the commitment. "So, I am going to approve the special request to make the requirement ... from 100% to 51%." the examiner said on the record.
