Planning and Zoning Manager Ida Clark told the council that Idaho Code §67‑6526 (updated effective July 1, 2024) clarifies that Areas of City Impact are under county jurisdiction. Clark said City staff negotiated the new area with Jerome County and that the county adopted its own Chapter 10 with procedures that preserve city review for certain items (for example, the county will still send special use permit and lot‑line adjustment applications in the Area of Impact to the City for review). Clark said the Planning and Zoning Commission recommended repealing Title 17.110 because the chapter is “no longer needed nor compliant.”
Councilman Dale Ross moved to adopt the ordinance; Councilman Jeri Ahrens seconded the motion and it passed unanimously. The ordinance’s text states the repeal is intended to avoid duplicative or conflicting regulations and is effective upon passage, approval, and publication as provided by law.
