Council approves Casey's rezoning, alley vacation and utility maintenance agreement
Summary

After public discussion and staff recommendations, the La Cygne City Council approved a set of land-use actions to permit Casey's Retail Company to develop a site in Block 56.
On Jan. 2, 2014 the council accepted Ordinance No. 1419 to rezone specific lots in Block 56 from R-2 to C-1 and simultaneously approved Ordinance No. 1420 to vacate the alley in Block 56 while retaining necessary utility easements. Council Member Esther Shields moved to accept the rezoning and the alley vacation; both motions passed 5-0. "Council Member Shields moved to accept Ordinance No. 1419," the minutes record.
The council also authorized a maintenance agreement to allow Casey's to connect to and be responsible for certain city utilities in Block 56 and directed the mayor and city clerk to execute the maintenance agreement. The agreements and ordinances were recorded in the minutes and tied to later permitting and construction activity at the site.
Why it matters: rezoning from residential to commercial and vacating road rights permanently changes land use and public access. The council kept utility easements to preserve the city's ability to maintain services. The maintenance agreement is meant to clarify responsibilities for utility upkeep in the development area.
