Developer asks planning commission to allow covenant/surety option so utilities can be installed under a development agreement

The Luxe Subdivision applicant asked the Mabton Planning Commission to allow flexibility in when public water and sewer are installed by recording a covenant or using the municipal code’s surety option instead of requiring all utilities to be in place before the final plat is recorded. Shane, the applicant’s planner, told commissioners the covenant would be enforceable and discoverable by title search, obligating successive lot owners to complete required utilities or otherwise meet the obligations in the development agreement.
Commissioners probed whether that approach could leave a later private purchaser stuck paying for long utility extensions. One commissioner described a prior case where a lot at the end of a subdivision bore significant utility costs and said the commission should not replicate that result. Shane and the owner, Esteban, said the development agreement would set the order of operations and the code provides a surety path; staff agreed to revise conditions 4 and 5 to explicitly allow fulfillment via a development agreement or surety under Mabton Municipal Code 19.16.0.120.
The commission’s recommendation forwards that modified condition to city council for a closed‑record hearing; staff will produce the final wording for council review, which commissioners said should protect private purchasers from unanticipated large costs.
