Weybridge Planning Commission approves Middlebury College boundary line adjustment with fence condition

The Weybridge Planning Commission voted unanimously on March 11 to grant a waiver and approve a Boundary Line Adjustment (BLA) requested by The President and Fellows of Middlebury College, moving 0.63 acres from the residential lot at 50 Sheep Farm Road to the adjoining storage-structures parcel at 124 Sheep Farm Road.
Gale Hurd moved, and Robin Foster-Cole seconded, the motion that the commission “grants a waiver of/to the language in Article II, Section 200 D of the Subdivision Regulations and further that the Boundary Line Adjustment requested by the President and Fellows of Middlebury College who own both parcels is approved as depicted in the Sketch Plan,” and set conditions for approval. The motion passed unanimously. Under the approved adjustment the residential parcel will be reduced from 5.02 acres to 4.39 acres and the storage-structures parcel will increase from 2.01 acres to 2.64 acres.
The motion included a condition requiring the college to erect a six-foot-high solid wood, stockade-type fence running approximately 110 feet eastward from where the new boundary meets the Town right-of-way to the topographic line 410 (which runs roughly from the southeast corner of the barn to the northeast corner of the three-car garage). The motion further allows the college to erect a chain-link fence on the storage-structures side of the stockade so long as it does not rise above the top of the stockade fence.
Commissioners said the barrier is intended to ensure children playing in the driveway at 50 Sheep Farm Road cannot accidentally enter the area with storage structures. The record indicates that materials for the BLA had been discussed at the February 11 meeting and that the only new administrative information provided for this hearing was an E-911 address (124 Sheep Farm Road) and a SPAN for the storage-structures parcel.
The public hearing concluded at 7:34 p.m. The Commission directed routine follow-up steps for recording the adjustment, including delivery of a Mylar to the Town Clerk and preparation of a new deed for attorney review.
