Butler County pays $12,633 to rebuild burned guardrail after dispute over landowner billing

Commissioners voted 5-0 to authorize J&J Contractors to rebuild a portion of guardrail damaged near SE Gray Road and SE Rosalia Keighley Road at a cost of $12,633.40. Public Works Director Curtis Mader told the board a pasture burn this spring and an earlier fire had damaged guardrail on the bridge; the county had prepared a $6,630.20 reimbursement bill for the south landowner.
Property owner Larry Willhite, who was present, told the board he objected to being singled out for reimbursement, saying the damage had been occurring for the last decade and that if some landowners are billed all should be billed. The board concluded Butler County would pay the full repair cost and approved the repair contract on motion by Commissioner Kelly Herzet, seconded by Commissioner Darren Jackson. The board also directed better communication between burn permit processes and Public Works so staff can be informed when pasture burns occur.
